About Austin Kim

Austin Kim is the founding attorney of H&H Law, an immigration-only boutique in Santa Ana, California. He has dedicated his legal career to immigration law — building a deeply experienced EB-5 practice in Southern California and serving the Korean immigrant community of Orange County for over 20 years.

Education & Background

Austin earned his Bachelor of Arts from the University of California, Irvine — a research university consistently ranked among the nation's best. He went on to obtain his Juris Doctor from McGeorge School of Law, University of the Pacific, a respected California law school with strong ties to the state's legal community.

Before entering private practice, Austin served in the California Attorney General's Office in the Business & Tax Division. This background in government legal work gives Austin a unique perspective on the regulatory environment that governs immigration proceedings — and reflects the rigor he brings to every client matter.

EB-5 Expertise

With 2,000+ EB-5 petitions processed, Austin Kim's track record reflects a national EB-5 practice, not just an Orange County one. This volume reflects sustained, deep expertise across both Direct EB-5 and Regional Center pathways.

Austin advises EB-5 investors on both Direct EB-5 and Regional Center pathways, reviews offering documents and business plans, prepares I-526E and I-829 petitions, and guides clients through concurrent adjustment of status where eligible. He is particularly experienced with Korean investor clients navigating the U.S. market from a Seoul or OC base.

Bilingual Korean-English Services

Austin Kim conducts full client consultations in Korean — no interpreter required. This is a rare and meaningful advantage in immigration law, where case details require precise communication. Many Korean immigrant clients specifically seek out Austin because they can explain complex family or business situations in their native language and trust that every nuance is understood.

Practice Focus

Austin's practice covers all immigration categories, with particular depth in:

  • EB-5 Investor Visa (Direct and Regional Center)
  • E-2 Treaty Investor Visa
  • L-1 Intracompany Transferee Visa
  • EB-1A Extraordinary Ability
  • EB-2 National Interest Waiver (NIW)
  • H-1B and Employment-Based Immigration
  • Family-Based Immigration
  • EB-3 Green Card (skilled, professional, and other workers)
  • EB-4 Special Immigrant (religious workers)
  • E-1 Treaty Trader Visa

Professional Memberships

Austin is an active member of the American Immigration Lawyers Association (AILA), the national association of immigration attorneys and law professors. AILA membership reflects a commitment to ongoing education, ethical practice, and staying current with the rapidly evolving landscape of U.S. immigration law — including policy changes, regulatory updates, and agency adjudication trends.
